These pages are intended to guide local units of government (LGUs) to follow the buffer law process as required by state statute §103F.48 while utilizing best practices that have been developed and implemented at the local level by SWCDs, counties and watershed districts.

Step 1: SWCD Compliance Review
SWCD inspects public water or public drainage system buffer to determine compliance
Step 2: Initial Contacts with the Landowner
SWCD contacts the landowner to let them know they are potentially out of compliance based on initial reviews and to offer technical assistance
Step 3: Notification of Noncompliance
If compliance has not been attained, the SWCD issues a Notification of Noncompliance (NON) to the enforcement entity (county/watershed district/BWSR).
Step 4: Corrective Action Notice Sent
Enforcement Entity issues Corrective Action Notice to landowner.
Step 5: Issuing Enforcement Action
Enforcement Entity carries out compliance provisions through adopted official controls.
Step 6: Parcel is Compliant
Compliance is verified and the landowner is notified that their parcel is considered compliant.
